The Lucky Charm Pty Ltd controls this site from its head office in Western Australia. The laws of the State of Western Australia govern these Terms of Use. If you choose to access this site you are responsible for compliance with applicable laws.

You are responsible for the safekeeping of your user name and password, The Lucky Charm Pty Ltd takes no responsibility if your account is misused by an unauthorised person.

This website may contain links to other websites controlled by external parties. The Lucky Charm Pty Ltd is not responsible for any content on external party websites. If you choose to visit these sites you do so at your own risk. 
 

Sale and Purchase

Your placement of an order with us for any goods displayed on this website constitutes an offer by you to purchase the Goods from us on these terms. The order is placed when it is submitted to us.
 
The order is accepted only when we notify you that we have accepted the order via email stating this and displaying confirmation on the screen. We reserve the right, at our discretion to limit the quantity of goods purchased and to reject orders. We will notify you if such limits apply.
 
Please note that we cannot make changes to an order or transaction once payment has been processed and the order has been closed.
 

Pricing Policy

All prices shown are inclusive of GST and in Australian Dollars ($AUD). 

• Pricing

  The Lucky Charm Pty Ltd reserves the right to alter and modify pricing on the website without notice. We may even introduce promotions for limited periods that alter the price. Orders finalised through the Checkout will be charged at the advertised price at the time of ordering and will not be affected by price changes between the checkout time and the delivery time.

• GST

  You must pay Goods and Services Tax (GST) at the prevailing GST rate on any taxable supplies made by us. The price includes GST. Any GST payable by you will be displayed on the checkout page prior to the submission of your order and will be shown on your invoice.

• Payment

  Payment is only accepted via PayPal and is required at the time of ordering.You must pay us any fees or costs imposed on us if payment you make to us is dishonoured or reversed. Subject to any limitation imposed by the law, any expenses, costs or disbursements incurred by us in recovering any outstanding money, including debt collection agency fees or solicitor’s costs will be passed on to you.

Secure Payments

When proceeding through to checkout, at the payment stage customers will be directed to a secure PayPal portal. This is the most secure payment option available for processing your payment. 

 

Delivery and Click & Collect Policy

We want to make your online shopping experience as quick and easy as possible. With this in mind we have two delivery options; Click and Collect from a preferred TLC store or get it delivered to a nominated postal address.
 
Please consult your order confirmation email for the delivery of your order. Most orders placed through our site will be available for collection/delivery usually within 48 working hours of receiving your order. However, some items or quantities require us to place extra orders with our suppliers. In the event an item ordered is not in stock, you will be contacted via email or phone to advise you of the estimated delivery time/collection. 

• Delivery

  Delivery can take between 3 – 10 business days from date of dispatch. If a delivery fee applies, it will be displayed on the checkout page prior to you submitting your order and on your invoice. Regional and country delivery may incur an additional charge. Please note severe weather conditions may also impact the duration of the delivery. 

• Damage in transit

  If any goods arrive damaged, please contact us immediately. We request you take a photo of the damaged item and e-mail it to us. TLC will then arrange a replacement to be sent out to you as soon as possible.  

• Click and Collect

  Place a Click and Collect order online and choose your preferred store for collection. You will be notified via email or phone once your order has been collated and ready to be picked up. When collecting your order from the store, please bring a copy of your invoice, order confirmation as proof of purchase. Your order can only be collected from the selected store.

The Lucky Charm Pty Ltd will not be liable for any loss or damage, whether direct, indirect or consequential arising out of the misdelivery, delayed delivery, failure to deliver or damages that may occur during delivery.

 

Return Policy

Our return is policy is in addition to your rights under the Australian Consumer Law because we want you to be happy with your purchase. 

We understand that there may be times when you need to return a product. If a product purchased from us is not fit for its purpose or an unacceptable quality (through no fault of your own) we will happily refund, exchange or where possible arrange to be repaired provided that: 

• The item(s) is brought instore within 30 days of purchase
• The original receipt is produced at the time of returning the items
• The item(s) is in re-saleable condition including all original packaging, instruction manuals and accessories
• The item(s) is in its original condition and is unopened and unused
• Items supplied incorrectly will be exchanged for the correct item providing they are returned unopened and unused

 The Lucky Charm Pty Ltd reserves the right to decline a refund should the returned item not suit the above conditions.
 

Change of Mind Returns

If you wish to return an item because you have changed your mind, The Lucky Charm will offer you an exchange voucher provided that:

• The item(s) is brought instore within 30 days of purchase
• The original receipt is produced at the time of returning the items
• The item(s) is in re-saleable condition including all original packaging, instruction manuals and accessories
• The item(s) is in its original condition and is unopened and unused
• Items supplied incorrectly will be exchanged for the correct item providing they are returned unopened and unused

The Lucky Charm Pty Ltd reserves the right to decline a refund should the returned item not suit the above conditions.

To return an item, simply visit the TLC store you purchased the product from. 

Promotions

We may issue promotional codes and special offers. These promotions cannot be transferred, sold or used any other time. Promotional codes are subject to the terms disclosed at the time of issue. We reserve the right to cancel any or all promotional codes and promotions at any time if we suspect error, fraud or abuse of the code. 

 

The Lucky Charm (TLC) Rewards Terms and Conditions

The Lucky Charm ("TLC") Rewards Card ("Card") will enable you to access member only benefits including:

• Promotions and special benefits, which may be offered from time to time.
• The ability to earn Charms throughout the year. Once earning the qualifying number of Charms you will automatically get $5 off your next eligible purchase at participating TLC stores. Expiry dates will apply for redemption.
• Special exclusive offers that may be redeemed against purchases.  

Membership to The Lucky Charm Rewards Program is free. 

The saving value of an offer may vary from time to time and will be advertised in store and on the website.

 

How to Register Your Card

You can pick up a Card from any TLC store. To register and activate your Card visit The Lucky Charm Rewards website at www.tlcrewards.com.au ("Website") or call our Customer Service Centre ("Call Centre") on 1300 582 592.

There is a limit of one Card per natural person. Corporations, partnerships and other entities are not eligible for a Card.

A Card is not transferable, and may only be used by the registered Cardholder.

It is your responsibility to keep your personal details updated.  If your personal details change and you fail to notify us of the change we might not be able to offer or provide to you with the benefits and may need to cancel your Card. If you wish to change your details, please visit our Website, call our Call Centre during business hours or, write to us at The Lucky Charm Pty Ltd, Unit 3, 691 Marshall Road, Malaga WA 6090.
 
If you no longer wish to be a member of The Lucky Charm Rewards Program you can deregister your Card by telephoning the Call Centre.
 
If a Card is deregistered, any Charms that have been added to that Card will be removed. Any current benefits will be credited back to the Card that accumulated them.

 

Other Benefits

If you register your Card, shop at a TLC store and swipe your card at the register before each purchase, you will qualify for other benefits which may be offered from time to time. Separate terms and conditions may apply to those promotions.
 
Other benefits include:

• member only discounts and newsletters and automatic entry into prize draw competitions which may be run from time to time.
• discounts and exclusive offers from members of The Lucky Charm group.

Other benefits will accrue to the Card to which they are issued; these can only be redeemed by that Cardholder and cannot be accessed by any additional Cardholders.
 
If at any time you do not wish to receive these benefits  you can telephone our Call Centre or click the unsubscribe link on an email that you have received from us.

Lost, stolen or damaged Cards

Keep your Card in a safe place.  If your Card is lost, stolen or damaged, visit our Website, telephone our Call Centre or write to us at The Lucky Charm Rewards Unit 3, 691 Marshall Road, Malaga WA 6090 or email tlcrewards@theluckycharm.com.au.  
 
If you have registered your Card and your Card is lost or stolen, The Lucky Charm may issue you with a replacement Card.
 
If your Card is damaged or unusable, The Lucky Charm may issue you with a replacement Card.  If your Card is registered or if the unique barcode on the Card is still readable, any benefits loaded on your damaged Card may be replaced by The Lucky Charm. 
 
The issuing of replacement Cards and the re-instatement of current entitlements to benefits on lost, stolen or damaged Cards is at The Lucky Charms' discretion.

 

Other Information

By joining The Lucky Charm Rewards or using your Card or claiming any benefit under The Lucky Charm Rewards program, you will be deemed to have accepted and be participating in The Lucky Charm Rewards on these Terms and Conditions.

We do not exchange benefits for cash, gift-cards or vouchers.

The Card cannot be used as a credit card, debit card or guarantee card.

Your Card is issued by and remains the property of The Lucky Charm.  The Lucky Charm reserves the right, at any time without notice, to:

• decline to issue a Card;
• on reasonable grounds, withdraw or cancel Cards, entitlements to benefits;
• terminate a Cardholder’s membership in The Lucky Charm Rewards Program; or
• terminate The Lucky Charm Rewards Program.

Reasonable grounds for withdrawal or cancellation include:

• any abuse or attempted abuse of the Card or The Lucky Charm Rewards Program
• any use or attempted use of a Card, entitlement to a benefits in a manner contrary to these Terms and Conditions;
• any use or attempted use of a Card, entitlement to a benefits for purchases made by a person (other than the Primary Cardholder or any linked cardholder)
• any reasonable suspicion of dishonesty of a Cardholder in connection with The Lucky Charm Rewards Program.

Any tampering or defacing or unauthorized use of a Card will render the Card invalid.

The Charms (points) will expire on a 12 month rolling system. That means, the Charms you earn today will expire 12 months from today. 
 

The Lucky Charm’s liability

• Any delay in replacing a lost, stolen or damaged Card.
• Any delay in uploading Charms (points)
• Any loss, theft or damage to any documentation in the course of post or delivery of that documentation.
• The suspension and/or termination of The Lucky Charm Rewards Program.

Privacy

The Lucky Charm respects your privacy.  We collect, store and use your personal information in accordance with the Privacy Act 1988.

You consent to The Lucky Charm using your personal information to operate and provide you with membership benefits of The Lucky Charm Rewards Program (including our membership newsletter) and to bring you other benefits from The Lucky Charm group. You also consent to The Lucky Charm group using your personal information to assist in planning, developing and researching product and service offerings involving The Lucky Charm group.

For example, we may:

• seek your participation (on a purely voluntary basis) in advertising campaigns, launches, customer testimonials, product testings and focus groups; and
• seek your feedback on The Lucky Charm Rewards Program, The Lucky Charm group advertising campaigns and The Lucky Charm group product and service offerings.

We have relationships with third parties to whom we make disclosures of your personal information in connection with such uses. You consent to The Lucky Charm group disclosing your personal information to those with whom we have service arrangements (these may include call centres, mailing houses and printers) and to those with whom we have alliance arrangements, where our disclosure is for the purpose of the above uses to which you consent.

Updates to Terms of Use

The Lucky Charm Pty Ltd reserves the right to change, suspend, ammend, revise or terminate these Terms and Conditions, The Lucky Charm Rewards program, and any benefits under The Lucky Charm Rewards program at any time. The Lucky Charm will give advance notice of any such circumstance on our Website or you can obtain such details by contacting our Call Centre on 1300 582 592. 

Where we change The Lucky Charm Rewards Terms and Conditions, The Lucky Charm Rewards program or any benefits under The Lucky Charm Rewards program, an updated copy of them will be available on our Website or by telephoning our Call Centre.  Continuing to use your TLC Rewards Card after the period of advance notice has expired will be deemed acceptance of the amended Terms and Conditions.
